Key points for correspondent firms

  • Mexico is single-class -- each class requires a separate application and generates a separate registration with its own maintenance deadlines.
  • Madrid Protocol designations covering multiple classes are split into individual national registrations. We track each one independently.
  • The third-year declaration of use is mandatory and non-extendable. IMPI does not send reminders. We build this into our docketing from day one.

  • The recent reforms to Mexico's IP law in 2026 introduced a reduced maximum substantive examination period to one year, limited office actions to a maximum of two, and introduced priority restoration for applications filed after the Paris Convention deadline.
  • PPH is one of the most effective tools for accelerating prosecution in Mexico.

  • The April 2026 reform introduces priority restoration for design applications and a maximum two-month resolution period for design renewals.

Key points for correspondent firms

  • Mexico's primary IP enforcement route is administrative (through IMPI), not judicial. IMPI investigates, resolves and sanctions. Decisions are appealable to the specialized IP court and ultimately through amparo.
  • Preliminary injunctions are available but can be neutralized by the respondent posting a counter-bond. We advise on the strategic implications before recommending this route.
  • The April 2026 reform extends infringement liability to conduct carried out through AI tools, introduces ambush marketing as a sanctionable infringement, and enables electronic filing of enforcement proceedings.
